You’ve Been in an Accident – Now Pull Out Your Phone!

If you have been involved in a motor vehicle accident or slip and fall, your attention is probably focused on exchanging information with the other driver or assessing your own injuries.  

It is also very important to try to capture photos of the scene as it appears at the time of your accident.  These photos can be help establish liability and prove your case.  

If you are involved in a car accident, and you are able to exit your car safely, take the following photos:

  • the position of the vehicles involved;
  • the damage to both vehicles;
  • a picture from further back of the crash site to show perspective of the scene including the involved street(s); and
  • the at-fault driver’s license tag and his/her driver’s license and insurance card

If you are the victim of a slip and fall accident, and you are not taken away from the scene because of your injuries, a picture of the cause of your fall is critical.  Additionally, take a step back from the specific defect that caused your fall and get a perspective view with any identifying landmarks.  The time stamp that the phone creates on your photos will help rebut the defense that you are just guessing as to the specific defect that caused your fall, or that the defect arose over time after your accident.  

Most people travel around with their phone at their fingertips.  Be sure to put your phone to work for you and create a record that will help you be successful in your case.
